Govt may not contest SC’s U-18 wives ruling

NEW DELHI: The government may not challenge the Supreme Court verdict terming sex with a minor wife under the age of 18 as rape even as the Centre and states will need to struggle to implement the order.

 The issue has stumped successive governments which, wary of ruffling social sensitivities, have taken a conservative stand on the grounds that a large number of marriages take place in which the girl is aged between 15 and 18 years. But with the SC setting the age of consent for women at 18, the Centre has the opportunity to see the situation as a fait accompli where the matter has been taken out of its hands. Sources in the government said the order will discourage families from arranging underage marriages as these could attract punishment for the groom.
 It is believed that the order can accelerate the decline in such marriages as is evident from National Family Health Surveys. The percentage of women in the 14-20 age group married as minors has come down from 47% in 2005-06 to 26% in 2015-16. The order will impact Hindus the most, followed by Muslims. It has once again highlighted that the government will need to think out its position on issues where it has often banked on tradition to oppose radical change.
